These Terms and Conditions ("Terms") govern your use of the website www.ev-powershare.com (the "Site") and your purchase and use of products sold by EV-PowerShare Inc. ("EV-PowerShare," "we," "us," or "our"), including the ChargeXcel® EV Energy Management System.

By using the Site or purchasing our products, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.

1. About Our Products

ChargeXcel® is a UL 916 / CSA_US certified EV Energy Management System (EVEMS) designed to help qualifying homes add Level 2 EV charging without a panel or service upgrade by actively managing available electrical capacity.

Key product characteristics:

  • Rated 208V–240V AC, single phase.
  • 14.4 kW maximum input/output; 48A continuous load capacity; 60A maximum load capacity.
  • Combines dynamic load balancing with a hard load-shedding failsafe.
  • Stores energy usage and event data locally; no mandatory cloud subscription is required for core load management and safety features.
  • Configured via a local web portal at http://ChargeXcel.local.

Important: ChargeXcel is not appropriate for every home. Whether your home qualifies depends on your electrical system, local codes, and the permitting authority having jurisdiction (AHJ). We make no representation that ChargeXcel will eliminate the need for an upgrade in every home.

2. Qualification and Installation

  • ChargeXcel is designed to help qualifying homes add EV charging. Qualification depends on your panel configuration, available capacity, local electrical code, and AHJ requirements.
  • Installation must be performed by a licensed/qualified electrician. ChargeXcel is not a do-it-yourself product. You are responsible for hiring a qualified installer.
  • ChargeXcel must be installed inside a polycarbonate NEMA 4 junction box (recommended size 14" x 10" x 6"), which is not included with the product and must be obtained separately.
  • Your electrician is responsible for ensuring the installation complies with the National Electrical Code (including NEC 220.70 and 625.42(A) as applicable), local codes, and AHJ requirements.
  • We do not guarantee permit approval or inspector sign-off. Final approval depends on your local AHJ.

3. Orders, Pricing, and Payment

  • All prices are stated in U.S. dollars. The current MSRP for ChargeXcel 60 is $880, plus applicable taxes and shipping.
  • Orders are processed through our online store. We accept the payment methods offered at checkout.
  • We reserve the right to change prices, product specifications, and availability at any time without notice. Prices charged are those in effect at the time of checkout.
  • We may cancel or refuse any order, including orders that appear fraudulent, in error, or that exceed reasonable quantity limits.

4. Shipping and Delivery

  • We will ship to the address you provide at checkout. Risk of loss passes to you upon delivery to the carrier.
  • Delivery times are estimates, not guarantees. We are not liable for delays caused by carriers, weather, or events outside our reasonable control.
  • If you receive a damaged or incorrect shipment, contact us through our contact page within 7 days of delivery.

5. Returns and Refunds

  • Defective product. If your ChargeXcel unit is defective at the time of delivery, contact us through our contact page within 30 days of receipt. We will arrange a replacement or refund in accordance with this policy.
  • Warranty claims are handled under Section 6 below.
  • Promotional units are not eligible for cash refunds, but remain covered by the warranty in Section 6.
  • Return shipping for approved warranty or defect returns will be arranged by us.

6. Warranty

ChargeXcel 60 is covered by a 2-year limited warranty from the date of shipment.

What we cover: The warranty covers defects in materials and workmanship under normal use, for 2 years from the shipping date.

What we do not cover: The warranty does not cover:

  • Damage caused by improper installation, misuse, abuse, accident, or neglect.
  • Installation by anyone other than a licensed/qualified electrician, or installation that does not comply with the manual, the National Electrical Code, or local codes.
  • Damage caused by power surges, lightning, fire, water, or other external events.
  • Cosmetic damage that does not affect function.
  • Any product that has been modified, repaired, or altered by anyone other than EV-PowerShare or its authorized representatives.
  • The NEMA 4 junction box, EV charger (EVSE), wiring, or other third-party components.

Remedy: If a covered defect is confirmed, we will, at our option, repair or replace the product. This warranty is limited to repair or replacement of the product and does not include labor or installation costs, except as may be required by law.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Disclaimers

  • No guarantee of upgrade avoidance. ChargeXcel helps qualifying homes avoid panel or service upgrades, but we do not guarantee that any particular home will not require an upgrade, that an inspector will approve an installation, or that charging will always run at full speed. Charging speed may be adjusted during peak-load events to protect your electrical system.
  • EV compatibility. ChargeXcel's dynamic load balancing currently supports Tesla vehicles via Tesla's official API. Physical load shedding works with any Level 2 EV charger or high-power appliance up to 60A. Broader EV/EVSE dynamic load balancing support is planned. We do not represent that ChargeXcel works with every EV or EV charger.
  • The Site and all content are provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EV-POWERSHARE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Your Responsibilities

You agree to:

  • Provide accurate and current information when purchasing or registering products.
  • Have the product installed by a licensed/qualified electrician in accordance with the installation manual and applicable codes.
  • Not modify, tamper with, or bypass the product's safety features.
  • Not use the Site for any unlawful purpose or in any way that could damage, disable, or impair the Site.

10. Intellectual Property

The EV-PowerShare name, ChargeXcel® name and logo, the Site content, product images, and all related trademarks, service marks, and intellectual property are owned by EV-PowerShare Inc. or its licensors. You may not use, copy, or reproduce them without our prior written permission.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms, the Site, or our products shall be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. We will post any changes on this page and update the "Last updated" date. Continued use of the Site or purchase of products after changes are posted constitutes acceptance of the revised Terms.
